HOYIST is committed to protecting intellectual property rights and complying with the Digital Millennium Copyright Act ("DMCA"). This policy outlines our procedures for addressing copyright infringement and our stance on DMCA-ignored hosting. HOYIST offers hosting services in jurisdictions that may not recognize or enforce DMCA takedown notices. However, this does not give clients the right to host illegal, malicious, or harmful content. We reserve the right to investigate any abuse and act accordingly.
DMCA Hosting Usage Case
Our DMCA hosting is best for sites that host legitimate websites like ROI-based banking, casino, or crypto, no scamming sites.
All DMCA rules are to be noted. If you are hosting banking, crypto exchanges, hosting services, or such sites on our simple domains or hosting, we reserve the right to suspend and may terminate your account. We will provide a backup within a period of 24 to 72 hours. In this period, you cannot emotionally or legally blackmail or threaten the company or its employees; otherwise, we reserve the right to not unsuspend and may terminate your account without backups.
If we receive your simple report, then you will be suspended to move to our DMCA hosting or to another provider. We do not inform via any support channel about the report. We try to inform you, but it’s not guaranteed, so in the process, you may be terminated for over 24 hours until the reports calm down, and then we may provide you with the backup. In this case, note you will not qualify for a refund, even if your report is fake.
If we receive a report against you and the report is fake, you must move to our DMCA plans or to another provider. In this case, you cannot ask for a refund.
If the report is fake but you are still on our basic server, you are not supposed to prove the report is fake. We will not allow you to continue.
In case of moving from a simple plan to a DMCA plan, you cannot ask for a refund, nor will your simple account billing be settled. In DMCA, we can only offer you one option, to move you to DMCA servers and reset your old cPanel on our simple server so you can host other sites.
If we receive more than two reports against your cPanel, even if the domain is changed, you will be given 12 hours to move to DMCA or Offshore or WAREZ plan, or get terminated without refund.
DMCA Domains Usage Case
All DMCA domains are protected. We highly recommend buying a full-proof or offshore DMCA domain, not the basic one.
If we receive reports against your DMCA domain, there will be 2 cases:
1. If the report is from a single person or has no proof, it will not be counted, and we will ignore it.
2. If the report has proof, then in that case, we will inform you, and you will have to provide us with the proof and we will ignore them.
3. If the reporter is a company and files a legal legitimate case against you, and you will not able to provided us a complete proof, we will suspend and even terminate you with as little as 12 or 6 hours’ notice, with refund left only if you qualify for the refund policy.
For phishing domains, you are not supposed to be highly active. If we receive many reports or a legitimate company files a report against you, we will suspend and terminate your service or domain without notice, and you shall not be refunded.
Takedown Request Procedure
If you believe that your copyrighted work has been infringed upon, please submit a formal DMCA takedown notice to us. Notices must comply with Section 512 of the DMCA. We will review each claim and take appropriate action within the required timeframe.
Prohibited Content
HOYIST prohibits the hosting of content that violates any law or causes harm. This includes, but is not limited to:
- Child sexual abuse material (CSAM)
- Phishing, fraud, and identity theft
- Malware or malicious scripts
- Illegal streaming or pirated content
- Hate speech, incitement to violence, or terrorism
Hosting such content will lead to immediate suspension and may result in permanent account termination.
DMCA Takedown Notice Requirements
If you are submitting a DMCA takedown notice, include the following:
- Your full legal name and contact details
- Identification of the copyrighted work
- URL(s) of the allegedly infringing content
- A statement under penalty of perjury that the information is accurate
- Your physical or electronic signature
All takedown notices should be sent to contact on available support channels.
Client Responsibility
Clients are solely responsible for the content they host. HOYIST does not actively monitor client content but reserves the right to investigate upon receiving valid abuse reports. Misuse of our platform for hosting unlawful or infringing content may lead to immediate service suspension or termination.
False Claims & Abuse of Policy
Filing a false DMCA notice is a legal offense. Individuals or entities abusing this process may be subject to legal consequences under Section 512(f) of the DMCA and will be permanently banned from using our services.
Indemnification
You agree to indemnify, defend, and hold harmless HOYIST, its employees, agents, and partners from and against any claims, liabilities, losses, damages, or expenses arising out of your violation of this DMCA Policy or misuse of our services.
