Agreement to Terms

By using Hoyist's services, you agree to these Terms of Service (TOS), as well as all other policies referenced herein. It is your responsibility to read and understand these terms. If you do not agree to all parts of this document, you may not use our services.

Support Abuse

At Hoyist, we always treat our customers with the utmost respect. In return, we expect the same from you. If our staff feels that you are consistently addressing them in a demeaning or rude manner, your account may be suspended and you may be asked to take your business elsewhere. In the event that we terminate service for support abuse, customers will be given ten (10) days' notice to find a new host.

Hoyist will be the sole arbiter as to what constitutes a violation of this provision. Accounts found in violation of this provision will be subject to immediate account deactivation. Hoyist will turn all available information about abuse incidents, including customer contact data, over to the proper authorities and press charges.

Affiliate Terms After Account Creation
If you join the Hoyist Affiliate Program after creating your main account, the affiliate terms on our website will apply to you automatically. These terms apply whether or not you read them, and you are responsible for checking the website for updates. Continuing in the program means you accept the latest terms.

General Terms & Policies

Service & Content Usage

All Hoyist services may only be used for lawful purposes. Prohibited content includes, but is not limited to, copyrighted material, threatening or obscene material, and content that violates any local, national, or international law. You agree to indemnify Hoyist from any claims resulting from your use of our service.

Adult Content

Pornography, sex-related merchandising, and sites that link to such content are strictly prohibited. Violations will result in immediate account termination with no notice. Backups, if available, may cost over $100 per GB.

Examples of non-acceptable content:

• Pirated software
• Bulk email products
• Pornography
• Hacking/cracking related websites
• Warez and/or copyrighted MP3s
• Movie websites
• Material illegal under United States law
• Sites linking to material considered detrimental to public health, safety, or welfare (e.g., Anarchists Cookbook, bomb-making, weapon information)
• Content that uses your hosting as a file storage drive (e.g., movies, zip files, software, backups).
• Any other material that is not directly related to an active website or CRM.

Such sites will be deleted without prior notice. Backups, if available, may cost over $100 per GB.

Hoyist will be the sole arbiter as to what constitutes a violation of this provision and reserves the right to deactivate and remove any site at any time for any reason.

Copyright Violations

Hoyist will respond to all reports of infringement that comply with the Digital Millennium Copyright Act (DMCA) and any other applicable copyright laws. Notices that do not comply will not be processed.

System Resource Usage

If Hoyist determines that an account is using an unacceptable amount of system resources, Hoyist may temporarily deactivate the account. If necessary, an eviction notice may be sent to the customer, providing 12 hours to upgrade to a recommended solution or find a new provider. Each case is considered individually.

Backups

Hoyist performs nightly backups of Shared Hosting, Reseller Hosting, and WordPress hosting accounts for administrative purposes only and these backups are NOT GUARANTEED. Customers must maintain their own backups. Hoyist does not compensate for lost or incomplete data.

Manual backups via JetBackup are available. cPanel backup generation by our team is chargeable. Contact Billing for pricing.

Do not use your account as a backup solution. Hoyist may remove backup files from your hosting account.

We may delete the following if consuming excessive disk space:

• cPanel or Softaculous backups stored locally
• Backup temp files
• Backup logs
• Large error logs
• Unnecessary large files not essential to core functionality

JetBackup supports UTF-8 filenames, but avoid special characters due to filesystem issues.

Unsolicited Email (SPAM)

Sending unsolicited email (SPAM) from or through a Hoyist server is strictly prohibited. Sites found violating our SPAM policy will be immediately deactivated. Cleanup costs may be billed at $90/hour.

WhatsApp or Social Media Support

WhatsApp is only for sales support. For technical issues, open a ticket. Abuse at WhatsApp team may result in immediate suspension/termination with six (24) hours' notice. Backup recovery may cost $100 per GB.

Service Suspension for Inactivity

If your account is inactive for over twenty (20) days, all services may be suspended without notice. Backups may not be available or may cost over $100 per GB.

Cancellations

Cancellations must be submitted through the client area. All data may be removed permanently upon processing. Refunds (if eligible) are processed within 30 days. Refund delivery to your bank may take up to 25 days.

Payments and Billing

Renewal notices are sent at least 3 days prior to the due date. Automatic billing applies unless canceled. All payments are in USD.

Ensure accurate billing information. Hoyist is not responsible for fees charged by your bank.

Late Payments

We send invoices at least 3 days before due date via automated system. If the system fails to send notice, it is the client’s responsibility to check and renew services. After the due date, accounts are terminated. Backup may be available if the server’s backup cycle is active that week, but recovery costs $10 or more. We do not guarantee backups after termination. It is the client’s responsibility to pay on time to keep the account active.

Duplicate Payments

Duplicate payments are automatically credited to your Hoyist account. Request refunds within 3 days. Monetary refunds may be reduced by 40% for gateway fees.

Money-Back Guarantee

30-day money-back guarantee applies only to Shared, Reseller, WordPress, and similar hosting (if canceled within 29 days). Custom services, licenses, domains, add-ons, renewals, or violations are non-refundable.

Refunds are only for first-time customers and only for one eligible product.

Introductory Offers

Only for new projects or new customers. Existing services are not eligible. Abuse leads to termination. Backups may cost $100 per GB.

Free Migration

Free migration available within 30 days of sign-up. No guarantees on success. No liability for data loss. Outside 30 days, fees apply.

Free Domain

Free domain on 12/24/36-month plans (selected extensions). Canceled accounts within the refund window will be charged the domain cost.

VPS Reseller Terms

No refunds for VPS or deposits. 30-day duration. No backups unless purchased. Illegal or spam activity leads to immediate termination.

Backups are not included. It is the user’s responsibility to manage their own backups.

No allowed websites on basic hosting

You cannot host movies, illegal drugs, non-copyrighted songs, banking, phishing, scamming, or trading signal portals. Hosting such sites can lead to competitors filing fake reports, which causes issues for us. If we receive any report, official or not, we reserve the right to suspend your account without notice. In such cases, we may ask you to change your DNS first. Backups may take 24 to 48 hours to be provided and may cost $100 per GB. We reserve the right to terminate your entire account if you violate these terms.

User Content

You can upload, store, publish, display, and share information, text, photos, videos, and other stuff through our services (called User Content). This includes anything you post or that users of your websites hosted by us post. You're responsible for making sure your User Content follows this agreement.

We don't control or take responsibility for User Content or any info that goes through our systems. We don't keep an eye on User Content.

If you break this agreement, we might take action, like removing part or all of your User Content or your websites, or stopping our services, without giving you a refund. You agree that we're not responsible for any action we take to fix things.

Not allowed content

Having good storage in your plan does not mean you can use your hosting as a drive to store things. You cannot host movies, zip files, archives, backups, software, or anything that doesn't relate to an active website or CRM. Doing this can lead to immediate suspension with no notice or termination, and backups may cost $100 per 1GB.

Legal Use Responsibility

Clients are solely responsible for ensuring their content and usage comply with all local, national, and international laws.

Affiliate Terms

The Affiliate Program is available for shared and cloud hosting only. Affiliate accounts must be manually approved; otherwise, the payout will be declined. We offer a 25% commission on all hosting, except for Cloud VPS and Dedicated Server, with a minimum affiliate purchase of 1 year.

We do not offer affiliate commissions on domain registrations, transfers, or renewals. Affiliate payouts are made once a minimum payout limit is met, which is set in the client area and can be changed at any time.

Hosting sales can be tracked by both promo codes and links. The promo code is the primary tracking method in our system. The payout for hosting sales will be given 30 days after the sale. You can receive payouts via crypto or local banks in Pakistan.

All orders are manually checked before payout. If we find orders from the same IP or other links indicating you purchased services from two different accounts, your affiliate account will be deactivated, and you will not receive any payouts. Both accounts may be terminated. If we find this after one year, it may lead to service termination or a fine equal to the total affiliate payment.

Domain Registration, Renewal, Transfer & Management Conditions

1. Domain prices may vary based on internal system policies.
2. The listed pricing doesn't apply to premium domains.
3. Once a domain is registered or transferred, it's locked for 60 days as per ICANN's transfer policy.
4. No refunds or replacements for domain services after registration or transfer.
5. DNS management is limited to changing name servers on our site; contact support for other DNS configurations.
6. After domain expiry, auth and unlocking aren't available; renew with us before transferring.
7. Expired domains may not appear in your account due to registry deletion processes.
8. We're not liable for expired domains; we may attempt renewal upon payment.
9. Redemption or grace fees may apply post-expiration.
10. Our domain management tool is in beta; contact us for issues.
11. We're not an ICANN accredited registrar; we use reseller panels and APIs.
12. Real-time domain registration isn't available; activation can take up to 48 hours.
13. Domains can be ordered by multiple users simultaneously; ownership goes to the first payer.
14. Simultaneous payments lead to ownership disputes.
15. Ownership disputes are resolved via group discussions; otherwise, the domain is deleted.
16. Domains violating our terms or reported for misconduct can be deleted anytime.
17. Country TLDs require additional eligibility criteria and documents; non-compliance leads to suspension.
18. Free domains are included with selected plans; renewal is required after 1 year.
19. Our domain search system is in beta and may not detect premium domain prices.
20. Promotional prices and codes are for new domain registrations only; misuse leads to order cancellation.
21. We may use large registrars or companies to sell domains.

Website Migrations

We provide website migration as a courtesy, but cannot guarantee availability or time for the transfer. We only offer assistance with cPanel migrations; for other control panels, we are unable to facilitate the process. We can help in this case to move the account manually, but this may take over 72 hours and may incur additional charges.

Prohibited Persons

Service is not available to individuals or entities in sanctioned countries or those on the OFAC SDN list.

Service & Data Rules (Simplified)

• Free services may change or be removed.
• Resource limits can be adjusted.
• Free services are not permanent.
• We choose how and when to notify you.
• Check your email for updates.
• We can update terms anytime.
• Data may be accessed by authorized staff.
• Non-compliance can lead to termination.

Hoyist may deactivate any site for any reason without warning. Most violations get a warning, but this is not required. Hoyist has full discretion in enforcing its policies.

Pricing Adjustment and Enforcement Policy

Service Control & Governance

Operational Continuity: Hoyist may discontinue, alter, or remove any service, feature, or functionality at any time without prior notice.

Service Discretion Rights: Hoyist holds full discretion to suspend, throttle, or terminate accounts or services without justification when operational integrity is at risk.

Data Access & Governance: By using Hoyist services, users grant internal access to account data for monitoring, compliance, and support. Access is limited to internal use only.

Terms Modification: Hoyist may revise these Terms of Service at any time. Continued use of services implies agreement to the latest version.

Account, Billing & Ownership

Account Ownership Definition: The account owner is the person or entity listed in the billing profile. Ownership disputes will only be resolved based on this data.

Accuracy of Information: Clients must keep account, billing, and contact information accurate. Inaccurate or outdated info may result in suspension or data loss.

Chargebacks & Disputes: Initiating a chargeback or payment dispute results in immediate service suspension, permanent ban, and a $100 fine.

Funds

Funds within a user account shall remain valid for a maximum duration of two months. Thereafter, any remaining balance may be applied toward account continuity at our discretion. In the case of outstanding invoices, available funds will be automatically appropriated against the due amount. To avoid such application, cancellation of the associated hosting or service account must occur prior to the invoice due date. Should the available funds be insufficient to satisfy the invoice in full, they shall expire on the final invoice date or subsequent to the fifteen-day “leap-in” reinstatement period.

Legal & Liability

Force Majeure Clause: Hoyist is not liable for service failure due to events beyond its control — including natural disasters, war, internet backbone failures, or government actions.

Limitation of Liability: Hoyist is not responsible for lost profits, lost data, or indirect damages arising from service usage, suspension, or failure.

Disclaimer of Warranties: All services are provided "as-is" with no guarantees of performance, uptime, or merchantability. Use at your own risk.

Governing Law & Jurisdiction: These terms are governed by the laws of [Your Country/Province]. Disputes shall be resolved in courts located in [Your Legal Jurisdiction].

Ownership Rights, Data Transfer & Policy Amendments

Business and Asset Transfer: Hoyist, including all its associated infrastructure, intellectual property, user accounts, service data, and databases, may be sold, assigned, merged, or otherwise transferred to any third party, entity, or acquiring organization without prior notice or consent from any user or affiliated party.

User Data Disclosure and Monetization
Utilization of Hoyist services shall constitute irrevocable, perpetual, and unrestricted consent by the user to the collection, retention, processing, compilation, aggregation, anonymization, de-anonymization, commercialization, monetization, dissemination, sublicensing, conveyance, and or transference, whether directly or indirectly, of any and all user associated datasets inclusive of but not limited to personally identifiable information, non personally identifiable information, metadata, content artifacts, transactional records, behavioral logs, and derivative informational constructs to or for the benefit of any internal division, affiliated entity, governmental or regulatory authority, strategic partner, marketing consortium, data broker, acquirer, or any other third party, whether domestic or foreign, for any operational, administrative, analytical, compliance, commercial, or otherwise determined purpose, at Hoyist’s sole and absolute discretion, and without the requirement of prior notification, subsequent disclosure, user approval, opt out mechanisms, or any form of monetary or non monetary remuneration, rebate, or consideration to the user.

Amendment of Terms Without Compensation: Hoyist reserves the unrestricted right to alter, expand, restrict, or completely modify these Terms of Service at any time. Continued access to services following such changes constitutes binding acceptance. In the event of termination due to any policy change, user dissatisfaction, or refusal to comply, no refund, credit, or compensation shall be owed or issued under any circumstances.

Pricing & Fee Changes
Hoyist may modify, increase, or reduce any service price, fee, or billing schedule at any time without prior notice. Continued use of services after such changes constitutes acceptance. No refunds or credits will be issued for price adjustments.

Enforcement & Revisions

Failure to Follow Policies

Non-compliance with these terms is grounds for account suspension and/or termination. While our normal policy is to issue a warning first, we reserve the right to remove any account without prior notice. Hoyist will be the sole arbiter as to what constitutes a violation.
